TERMS AND CONDITIONS OF PURCHASE

1. General Provisions
1.1. These terms and conditions of purchase/sale (hereinafter referred to as the “Terms”) are a legally binding document for the Parties, establishing the rights, duties, and responsibilities of the Buyer when the Buyer purchases goods from the www.tatapaper.lt online store.
1.2. The Seller reserves the right to change, amend, or supplement these Terms at any time in compliance with legal requirements. The Buyer will be informed of any changes on the website. The Terms applicable at the time of placing the order will apply to purchases made.
1.3. The right to purchase from our online store is granted to:
1.3.1. Legally competent individuals, i.e., individuals who have reached the age of majority and whose legal capacity is not restricted by court order;
1.3.2. Minors aged between 14 and 18, only with the consent of their parents or guardians, unless they have their own income;
1.3.3. Legal entities;
1.3.4. Authorized representatives of all the above-mentioned persons.
1.4. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer forms a shopping cart in the online store, indicates the delivery address, selects the payment method, reviews the Seller’s Terms, and clicks the “Confirm Order” button (see the section “Order Placement, Prices, Payment Procedures, and Deadlines”).
1.5. Each contract concluded between the Buyer and the Seller is stored in our online store.
Privacy Policy and Personal Data Protection
2.1. When ordering goods, the Buyer must provide the necessary personal data for order fulfillment in the information fields provided by the Seller: name, surname, exact delivery address, phone number, and email address.
2.2. By confirming these Terms, the Buyer agrees that the personal data provided under clause 2.1 will be processed for the purpose of selling goods/services, analyzing seller activities, and direct marketing.
2.3. By agreeing that the Buyer’s personal data will be processed for the purpose of selling goods/services in the Seller’s online store, the Buyer also agrees to receive informational messages necessary to fulfill the order at the provided email address and phone number.
Buyer’s Rights and Obligations
3.1. The Buyer has the right to purchase goods from Tata Paper in accordance with these Terms and other information sections of this online store.
3.2 The Buyer has the right to withdraw from the contract for the purchase and sale of goods with the e-shop by notifying the Seller in writing (by e-mail, indicating the product to be returned and the order number) not later than within 14 (fourteen) days from the date of delivery.
3.3 The Buyer may exercise the right provided for in section 3.2 only if the goods have not been damaged or substantially altered in appearance and have not been used.

3.4 The Buyer undertakes to accept the goods ordered and to pay the agreed price for them.
3.5. If the data provided in the Buyer’s registration form changes, the Buyer must update it immediately. The Buyer loses the right to make any claims regarding incorrect order fulfilment if incorrect data is provided and not corrected within 12 hours.
3.6. By using the online store, the Buyer agrees to these purchase-sale Terms and undertakes to comply with them and not violate the laws of the Republic of Lithuania.
Seller’s Rights and Obligations
4.1. The Seller undertakes to provide all conditions for the Buyer to properly use the services provided by the online store.
4.2. The Seller has the right, without prior notice, to suspend or terminate the registration, order execution, and/or use of the online store services if there is reason to believe that the Buyer is engaging in illegal activities or otherwise attempting to harm the Seller’s online store operations or stability.
4.3. The Seller undertakes to respect the Buyer’s right to personal information specified in the online store’s registration form.
4.4. The Seller undertakes to deliver the ordered goods to the address specified by the Buyer.
Order Placement, Prices, Payment Procedures, and Deadlines
5.1. The Buyer can purchase goods from the online store 24 hours a day, 7 days a week.
5.2. The contract comes into effect when the Buyer clicks the “Confirm Order” button, and the Seller confirms the order by sending a confirmation email to the Buyer’s specified email address.
5.3. The prices of goods in the online store and in the formed order are indicated in euros, including VAT.
5.4 The Buyer shall pay for the Goods in one of the following ways:
5.4.1. Payment by e-banking – via paysera.lt or paypal.com payment systems.
5.4.2. The Buyer transfers the money to the e-shop payment account. The responsibility for data security in this case lies with the respective bank, as all monetary transactions take place in the bank’s e-banking system.
5.5 The Buyer undertakes to pay for the goods immediately. Only upon receipt of payment for the goods, the order will be processed and the delivery period will start.

Goods Delivery

6.1 The Buyer undertakes to specify the exact place of delivery of the Goods by selecting the delivery service at the time of ordering.
6.2 The Goods are delivered by the Seller’s authorised representative (service provider).
6.3 If the goods you have ordered have already been manufactured and you pay by e-banking plug-in or by a prepayment order, the goods will be delivered within 3 – 5 working days.
6.5 If the goods are not available and need to be sewn, delivery may take over 10 days. In the case of a special order delivery, we will agree the delivery time separately, but the maximum delivery time will normally not exceed 3-4 weeks.
6.6 The Seller will deliver the Goods to the Buyer in accordance with the terms set out in the descriptions of the Goods. The Buyer agrees that in exceptional cases the delivery of the Goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In such case, the Seller undertakes to contact the Buyer immediately to agree on the terms of delivery.
6.7 In all cases, the Seller will be exempt from liability for breach of the time limits for delivery of the goods if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Seller’s control.
6.8 The Buyer is obliged in all cases to inform the Seller immediately if the consignment is delivered in broken or otherwise damaged packaging, if the consignment contains unordered goods or the wrong quantity of goods, or if the consignment is incomplete. Failure to notify the Seller shall exempt the Seller from liability to the Buyer in respect of damage to the goods in connection with damage to the packaging.

Goods quality and guarantees
7.1.The details of the goods sold in the Tatapaper.lt e-shop are specified in the description of each product.

7.2 In accordance with the Civil Code, the seller guarantees the quality of the goods in all cases (statutory warranty). For consumers, this provision is laid down in Article 6.363(1) of the Civil Code. The Civil Code establishes two types of guarantee for goods: the statutory guarantee, which is valid for two years from the date of purchase of the goods (Article 6.338 of the Civil Code; for consumers, this provision is additionally laid down in Article 6.363(10) of the Civil Code), and the contractual or commercial (quality) guarantee, which is considered to be a supplementary guarantee provided by the seller on top of the statutory guarantee.

8. Returns and exchanges.
8.1 Quality goods purchased online may be returned within 14 (fourteen) days from the date of delivery to the buyer.
8.2 The following conditions must be complied with when returning goods:
8.2.1. the returned goods must be in their original packaging in good condition;
8.2.2. the goods must be undamaged by the Buyer;
8.2.3. the goods must not have been used and must not have lost their merchantable appearance (intact labels and protective films, etc.);
8.2.4. the returned goods must be of the same composition as when received by the buyer, including the return of any gifts received for the purchase.
8.3 If the above conditions are met, you must notify your intention to return the goods by email to tatapaper@ tatapaper.lt
8.4 Upon receipt of your request, we will contact you within 2 days to arrange the details of the return.
8.5 Once we have received the goods and we are satisfied that the goods are unused, we will refund your money to the account you have specified within 5 days.
8.6 Goods made to special order are not returnable.
8.7 Goods of defective quality shall be exchanged for goods of satisfactory quality and the goods shall be returned in the cases and under the conditions set out in Articles 6.363 and 6.364 of the Civil Code.
9. Responsibilities of the buyer and seller.
9.1 The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer fails to provide accurate personal data on the order form, the Seller will not be liable for the consequences thereof and shall be entitled to claim direct damages from the Buyer.
9.2 The Buyer is liable for the actions carried out using this e-shop.
9.3 The Seller will be exempted from any liability in cases where the loss is caused by the Buyer’s failure to read these Terms and Conditions, despite the Seller’s recommendations and the Buyer’s obligations, despite having been given the opportunity to do so.

9.5 If the Seller’s e-shop contains links to the e-sites of other companies, institutions, organisations or persons, the Seller is not responsible for the information contained therein or the activities carried out therein and does not maintain, control or represent such companies and persons.
Marketing and Information
10.1. The Seller may initiate various promotions in the online store at its discretion.
10.2. The Seller has the right to unilaterally change the conditions of promotions or cancel them without separate notice. Any change or cancellation of the promotion conditions is effective from the moment it is made.
10.3 The Seller sends all communication by the means of communication specified in the Buyer’s order form.
10.4 The Buyer shall sends all messages and questions to the telephone numbers and e-mail addresses indicated in the “Contact” section of the Seller’s e-shop.
10.5 The Seller is not liable if the Buyer does not receive information or confirmation messages sent due to disruptions in the networks of the internet connection, email service providers.
11. Final provisions.
11.1 These Terms and Conditions of Sale and Purchase of Goods are made in accordance with the laws and regulations of the Republic of Lithuania.
11.2 All disagreements arising from the execution of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
